True enough, although the 800 remains for now (forever) on the outside looking in.

You might have some chance with a Code Transplant to FIX Functionality......i.e. Trifield

But I really don't think that a Transplant to INCREASE Functionality (Apodizing) would last more than a few minutes against the Law and existing Case-Law precedents

No, but who is going to take the person to court??

We live in a world were even Sony don't think it is worth taking people who reverse engineer their playstation code to court, same with Nintendo.
These are people who sell chips that 100's of thousands of people use that allow them to then download (steal) the software that really makes them money, and they still don't think it is worth chasing, and I know for a fact Sony think that the cheap and easy chips for the PS1 helped make them become the number 1 console manufacturer.

Meridian may well find it a concern, however that is where it will end imho.
It will be an annoyance to them and nothing more.

How many people loaded the firmware? Maybe a dozen??

OH MY GOD!!!! What a muddle to get in, call in the lawyers!!

Sorry if I am being a bit light hearted, I know a couple of people like to take it all very seriously.

I agree with everything that has been said, however, I reckon people on here are concerned about this far more than Meridian are.

Is the hypothetical firmware still available for purchase or has it been withdrawn? wink

Cheers

I actually agree with your post.

My grievance is not that Erwins tweaks exists, but that a derivative version is being sold for profit.

But hey, if I had a processor without apodising, it would be a shame to let the work on the original tweak go to waste... By hand modifying the filter coefficients for my own personal use of course wink

If I may, I would like to give you a quote or two from Jurassic Park:

"Dr. Ian Malcolm: You read what others had done, and you took the next step. You didn't earn the knowledge for yourselves, so you don't take any responsibility for it. You stood on the shoulders of geniuses to accomplish something as fast as you could, ".

"Yeah, but your scientists (in our case 'hacker') were so preoccupied with whether they could, that they didn't stop to think if they should."

Keep in mind all of the below is theoretical and that I have no idea what the facts are...

My opinion and I am not a lawyer:

If the code is Erwin's unique code and IP, using it is comparable to jailbreaking an iPhone or unlocking the bootloader on an Android device. I don't have an issue with it being installed.

If it came from Meridian's IP, like a DSP speakers' firmware then I have a big issue with it, but salute the ingenuity of the accomplishment.

In my posts I think I've indicated that whose IP this is is the fundamental issue for me.

Hi John
In simple terms......

a) the Lines of Code that made up the Apodizing Filter implementation in the D5K2's Firmware were identified........and then Extracted

b) Back in late February 2011, the Apoupdate Program was made available to Hikers........this enabled a User to replace the existing Linear Upsampling code in their Processor or DSP with the Upsampling / Minimum Phase / Apodizing Code from the D5K2 ..... the D5K2 Apodizing code was not changed in any way from Meridian's version

Meridian's Response is Here

I'll leave you to draw your own conclusions

Yes, and the point about Apoupdate was that Erwin only distributed his own software. Apoupdate only enabled users to create the new software themselves. He didn't sell or distribute Meridian's software to anyone.

He did nothing wrong, I mean, you do more wrong by lending someone a CD or DVD, that is illegal.

Or is that an old wives tale?

I think we are at the point where the polarised interpretations have all been made.

Anyone know a lawyer who also likes hi-fi?

Sheesh Gizze
Three things covered by your above post.......and off base on all three

The Rights to Use (i.e. Play) an ORIGINAL CD / DVD / Bluray pass to whoever Possesses the Disc.........that's why we can sell our CD's.........and why Amazon, Play and local Shops run thriving businesses selling 2nd hand DIscs of all Types

Obviously the Copying of DVD's and Bluray's is still "Illegal"........"Fair Use" does not apply due to the DMCA.........and CD Copying for Owner use only became "legal" in the UK in September last...........(I don't agree with any of this, but then I don't agree with many of the arcane Speed limits either.......but I won't be using this as my Defense the next time I'm up for speeding either smile )

As regards the main issue on this thread, which part of the the following Directive / Law do you think results in your interpretation above about "nothing wrong"

Quote
The unauthorised reproduction, translation, adaptation or
transformation of the form of the code in which a copy
of a computer program has been made available
constitutes an infringement of the exclusive rights of
the author.
