Unfortunately, due to continued absence of communication from Gary, I have formally escalated my PayPal dispute to a claim. I am, frankly, astounded that Gary has not responded via the PayPal channel in the ten day period since I raised the dispute. I have told him that I will cancel the claim immediately if he refunds me in full within 24 hours.

I too have regrettably just filed a claim. I tried to raise it as a dispute, but got the following automated message from PayPal:

"Your seller is currently unable to respond to this dispute. By escalating your dispute to a claim, you are asking PayPal to review the case and decide the outcome."

Not sure quite what it means, but the fact it wouldn't let me raise this as a dispute first made my mind up.

My last email from Gary promised the unit would be sent by 4 September.

To keep all informed of the current state of affairs.

I have received an email this morning from Mr Murrell in reply to my email of last Sunday. He tells me that my unit will ship on Monday, "no more delays". He has not responded to my email of two days ago requesting the cancellation of my order and a full refund within 10 days.

I was thinking Gary may be responding to people who have requested a refund or otherwise submitted claims with PayPal, et al, but I filed claims with both PayPal and AmEx and haven't heard back from Gary yet. However, the lateness of the claims -- remember it's been over four months for me, so both PayPal and AmEx are doing me a favor -- means that the word may not have percolated through to Gary's inbox yet.

I have received notification today from Paypal today that a full refund has been credited to my account so I think I can now put this episode in the 'all's well that ends well category'.

It would be nice if Gary could explain to this forum clearly what has gone wrong. Even at this stage I am sure there are those who still want to purchase a product like this. The longer the silence the less the chance we will buy anything imo.

How about it Gary, this is probably your last chance for those of us who have not been burned.
